Thailand SEC Files Criminal Complaint Against Bitkub Over Alleged Concealment of 2021 Cyberattack

Ltd., one of the country's largest cryptocurrency exchanges, and two of its former directors. The complaint alleges that the company concealed a major cyberattack in 2021 and submitted false information to the regulator, bringing transparency and accountability in digital asset markets back into focus.
The criminal complaint stems from a cyberattack in May 2021, during which hackers reportedly stole 16 different types of digital assets from Bitkub. The estimated value of the stolen cryptocurrencies is approximately 1.7 billion baht, or about $50-51 million. According to the SEC's allegations, Bitkub failed to accurately reflect this significant asset loss in its daily net capital reports (Form DA 1 or Dor Jor 1) submitted between May 10 and October 30, 2021, thereby making false statements. The SEC stated that this omission gave the impression that customer assets remained normal and that the company had not suffered any damage.
Bitkub, in its defense, issued a statement asserting that the decision to withhold information about the cyberattack from the public and regulators was a deliberate choice aimed at preventing a mass withdrawal of funds, commonly known as a 'bank run.' The exchange argued that disclosing the incident at the time could have led to widespread panic among customers, potentially causing greater losses and harming Thailand's nascent digital asset industry. Bitkub also emphasized that its co-founders personally covered the losses of the stolen assets, ensuring that no customers were financially impacted. The company maintained that the incident was an external cyberattack, not internal fraud, and that its security systems have since been significantly upgraded.
This legal action intensifies regulatory scrutiny on Thailand's crypto market and could potentially impact Bitkub's parent company's plans for a public listing. Transparency and accurate reporting are fundamental to investor confidence in the digital asset sector. Such incidents tend to increase pressure for market maturation and the implementation of stricter regulations.
