The United States has launched new trade investigations under Section 301 of the Trade Act of 1974 after the Supreme Court invalidated parts of the Trump administration’s earlier tariff program. The move is seen as an attempt to rebuild a legal pathway for imposing tariffs on foreign imports while maintaining pressure on major trading partners.

Officials said the probes will examine whether policies such as excess industrial capacity and other trade practices by major economies harm U.S. commerce. The investigations, led by the Office of the U.S. Trade Representative, are expected to review the trade practices of several key partners, including China and India. Depending on the findings, the administration could impose new tariffs or other trade measures on affected countries.

Section 301 gives the U.S. government authority to respond to foreign practices considered unfair or discriminatory toward American commerce. The law previously served as the legal basis for tariffs of up to 25% on a wide range of Chinese imports during Trump’s first term, triggering a prolonged trade dispute between the world’s two largest economies.

Analysts note that Section 301 investigations could also function as a negotiating tool in global trade relations. Once the review process is completed, Washington may introduce more targeted and legally durable tariffs, potentially reshaping the next phase of U.S. trade policy.
