SEC Chair Paul S. Atkins told the Economic Club of Washington on April 21, 2026, that the commission is "on the cusp" of issuing an "innovation exemption" designed to provide a cabined framework for compliant on-chain trading of tokenized securities.

Atkins framed the exemption as part of the SEC's Project Crypto and pointed to recent work to clarify digital-asset classifications, including a token taxonomy intended to separate categories of crypto assets and reduce regulatory ambiguity. He also noted his remarks reflected his own views rather than a final Commission determination.

Practically, the move could enable limited experiments in tokenized securities trading that integrate blockchain settlement efficiencies with U.S. securities-law compliance, but the agency has not published exemptive text and key design choices remain open—such as eligible instruments, participant and volume limits, and specific compliance requirements. Market participants should expect an initial, tightly scoped pilot rather than immediate broad-based market access.

The announcement comes amid closer SEC–CFTC coordination and follows a March joint interpretive release that sought to clarify which digital assets are treated as securities, commodities or other categories. Policymakers frame the exemption as a way to bring tokenization benefits onshore while preserving investor protections and orderly market functioning.

Analysts say the exemption could accelerate tokenization initiatives and on-chain settlement pilots if the final terms address liquidity, transparency and custody issues. However, widespread adoption will depend on the published exemption's scope, any transitional restrictions, and subsequent rulemaking or guidance from the Commission. Market infrastructure providers, broker-dealers and issuers will therefore watch the text and implementation timeline closely.
