The trial, presided over by US District Judge Yvonne Gonzalez Rogers, has the potential to yield billions of dollars in financial repercussions for Meta's future.

The lawsuit began as part of a federal complaint filed in October 2023 by a coalition of 29 state attorneys general against Meta. The states of California, Colorado, Kentucky, and New Jersey are leading the claims, asserting that Meta deliberately designed its platforms, such as Facebook and Instagram, to be addictive and detrimental to the mental well-being of young people. The company is accused of utilizing features like infinite scrolling, autoplay, persistent notifications, and visual filters to maximize user engagement, while also concealing internal research regarding the potential harms of its platforms on young users. The trial is expected to last six to eight weeks, with Meta CEO Mark Zuckerberg and Instagram head Adam Mosseri potentially testifying. An advisory jury will be impaneled, but the ultimate decision rests with Judge Rogers.

This lawsuit poses a potential multi-trillion-dollar damages risk for Meta. The company has stated that the civil penalties sought by the states could reach up to $1.4 trillion, an amount closely approaching Meta's entire market capitalization. However, legal experts consider a payout of this magnitude unlikely, and Judge Rogers herself has called Meta's $1.4 trillion estimate “unreasonable.” The plaintiff states, on the other hand, estimate potential damages to be around $200 billion. Meta's Chief Financial Officer, Susan Li, warned investors last month that the company's legal challenges could result in a “material loss.” Beyond financial penalties, the lawsuit also seeks structural changes to Meta's product designs, including stricter age restrictions, removal of infinite scrolling, and modifications to recommendation algorithms. These changes could fundamentally impact the company's advertising-driven business model and revenue streams.

The lawsuit against Meta highlights the increasing regulatory pressure on social media companies in the US and growing concerns about their impact on youth mental health. Delays in enacting federal child online safety laws have prompted states to take a leading role in this area. The case has drawn comparisons to the landmark tobacco industry lawsuits of the 1990s, which resulted in billions of dollars in settlements. In a separate, earlier case in New Mexico, Meta was already ordered to pay hundreds of millions in civil penalties and implement design changes on its platform to protect children.

Analysts and market experts suggest that the outcome of this trial could set a precedent for the entire social media industry and profoundly influence Meta's future operations. The company may be compelled to increase investments in non-advertising artificial intelligence initiatives to mitigate such legal risks. The lawsuit is expected to create uncertainty regarding Meta's market valuation and investor confidence, potentially impacting the short-term trajectory of the company's shares (META). Across the industry, there are widespread expectations of new regulations and stricter oversight on the horizon.
