Johnson & Johnson Offers $5.5 Billion to Settle Baby Powder Lawsuits

Pharmaceutical and healthcare giant Johnson & Johnson (JNJ) has announced a proposed settlement of $5.5 billion to resolve approximately 76,000 lawsuits claiming its talc-based baby powder caused ovarian cancer. The company, while maintaining the claims are meritless, stated that this offer aims to bring an end to a decade-long legal dispute. The proposed agreement, which is contingent on acceptance by 95% of the claimants, had a positive impact on J&J's stock.

This settlement offer comes after Johnson & Johnson ceased selling talc-based baby powder in the U.S. in 2020 and globally in 2023. Despite the company's assertions that its products are safe and do not cause cancer, plaintiffs argue that prolonged use led to ovarian cancer. J&J had previously made three unsuccessful attempts to resolve the lawsuits through bankruptcy filings by its subsidiaries.

Under the terms of the agreement, the company plans to make an initial payment of $3 billion in 2027, with the remaining payments expected after 2028. Lawyers representing the plaintiffs suggest that the total payout could exceed $7 billion, depending on claimant participation. The World Health Organization's (WHO) classification of talc as "probably carcinogenic to humans" in 2024 further intensified the debate surrounding these legal proceedings.

The development positively impacted Johnson & Johnson's market performance. Following the settlement news, the company's shares (JNJ) rose in after-hours trading. Investors viewed the reduction of long-standing legal uncertainty, which has weighed on the company, as a positive development. While the potential long-term effects on the company's financial statements will become clearer in the future, this step is seen as a significant move towards alleviating a major financial burden.

This settlement covers the lawsuits in the United States but does not include similar ongoing claims in the United Kingdom. A significant product liability case involving over 7,000 potential claimants was filed in the UK in October 2025 and remains active. The potential for the company to face similar lawsuits globally indicates that long-term legal risks have not been entirely eliminated.

Analysts and market expectations suggest that this settlement marks a crucial turning point for J&J, allowing the company to focus on its core innovative medicine and medtech sectors. If the settlement is accepted by 95% of the claimants, Johnson & Johnson is expected to largely put this complex and costly legal process behind it. However, potential future lawsuits and the ongoing UK proceedings will keep legal risks on the company's agenda.
