South Korea’s Bithumb secured a legal reprieve after the Seoul Administrative Court granted a request to suspend enforcement of a six-month partial business suspension imposed by the Financial Intelligence Unit (FIU). The interim order pauses enforcement until the court decides the main administrative lawsuit.

The FIU announced on March 16 that it had fined Bithumb 36.8 billion won (about $24.6–24.8 million) for alleged breaches of anti‑money‑laundering (AML) and customer identification obligations, and ordered restrictions primarily targeting transfers to external wallets for newly registered users. The regulator cited roughly 6.65 million violations, including 45,772 transfers involving unregistered overseas virtual-asset service providers and millions of KYC and transaction‑restriction breaches.

The court said there was an urgent need to prevent irreparable harm if enforcement proceeded, noting that restricting external deposits and withdrawals for new customers for six months could significantly hamper a platform’s ability to attract users and operate competitively. The stay of enforcement allows Bithumb to continue normal operations while the substantive case is adjudicated.

This ruling comes amid a period of intensified regulatory scrutiny on South Korean exchanges following operational incidents and systemic control concerns earlier in the year. Regulators have signaled tougher oversight and higher compliance expectations across the sector, increasing potential compliance costs and reputational risk for major platforms. The court’s temporary relief does not remove the underlying legal and regulatory pressures.

Market observers say the stay reduces immediate liquidity and onboarding risks for Bithumb, but the ultimate outcome of the administrative suit will determine longer‑term implications. Analysts expect Bithumb to accelerate governance and AML/KYC remediation measures and to maintain close dialogue with regulators; should the FIU prevail, the exchange could still face lasting penalties or operational constraints.
